TOMST Lolly

(Android)

  • 从数据记录器下载的测量文件,以及由它们生成的文件(例如土壤湿度换算文件和修复副本);
  • 您为一次下载添加的内容:站点名称、备注、照片;
  • Lolly 随下载记录的内容:日期和时间、数据记录器的序列号、类型和固件版本、存储器的占用程度、时钟的偏差、下载如何结束,以及在您允许定位时的位置;
  • 与数据记录器通信的日志(见下文),以及在您发送或删除之前的崩溃报告(最长 30 天,最多保留最近的 40 份);
  • 应用数据库、您创建的备份、您的土壤校准曲线和设置,包括您已接受的这两份文本的版本;
  • 如果您使用自动导出:您的服务器地址、用户名以及密码或 SSH 密钥,以及等待上传的文件列表;

  • 获取您所用语言的本政策和《用户协议》,在首次设置时您同意之前,以及每次您打开它们时(第 7 节);

  • 您点按"检查更新"时的更新检查(第 7 节);
  • 您发送给 TOMST 的诊断日志(第 8 节);
  • 您发送给 TOMST 的崩溃报告(第 9 节);
  • 您用自己的邮件应用写给 TOMST 的邮件(第 10 节);
  • 在您设置自动导出之后,向您自己的服务器的上传(第 13 节);

  • 一份简短报告:您输入的备注、应用版本和版本类型、Android 版本和构建号、设备的品牌、型号和内存、创建时间、应用最近处理过的错误列表(错误的类型和代码中的位置,不含文件路径或消息文本),以及压缩包中各文件的名称和大小;
  • 相关数据记录器的诊断日志(第 5 节),以及在大小限制之内本设备最近使用过的其他数据记录器的诊断日志,其中包括这些下载的测量数据,以及数据记录器和适配器的序列号和固件;
  • 出现故障时 Lolly 当时另存的记录;数据记录器疑似故障时,关于它的一份简短技术报告;

  • 记录一次下载的地点(纬度、经度、海拔高度和定位精度),与该次下载一起保存在您的设备上;
  • 为该地点建议一个名称,名称在设备上从应用内置的地图数据中查找,坐标不会为此发送给任何在线服务;
  • 在首页显示您的位置、所在地区和海拔高度;
  • 在 Lolly 设置数据记录器时钟之前,用卫星时间核对手机时钟;

TOMST s.r.o.

  • 上传的诊断日志在到达 180 天后删除;只有在与之或同一设备相关的支持事项仍在处理时才会保存更久,并在该事项结束时删除;
  • 崩溃报告在到达 180 天后删除;
  • 邮件在处理您的请求以及理解同一设备日后问题所需的期间内保存;

  • 知悉并决定您的个人信息如何被处理,以及限制或拒绝处理:本政策即为说明,您可以不同意并不使用本应用;
  • 查阅和复制:应用持有的内容都在您的设备上,可随时查看和导出;对于您发送给我们的内容,可以向我们索取副本,或在符合法律规定的条件时要求我们将其转移给您指定的其他处理者;
  • 更正和补充:在应用中修改站点名称、备注和照片;如果您发送给我们的内容有误,请告诉我们;
  • 删除:设备上的内容您可以自行删除;您可以要求我们删除您发送的日志、崩溃报告或邮件;
  • 撤回同意:对于位置,在 Android 设置中撤回权限,或在 Lolly 的"设置"中关闭 GPS;对于您已发送的日志或崩溃报告,上传本身无法撤销,但您可以随时写信至 tomst@tomst.com 或 app@tomst.com,撤回您对其继续保存的同意,我们随后会将其删除。撤回不影响撤回前的处理,每次新的发送都会再次询问您;
  • 要求我们对本政策或我们处理您信息的方式作出解释说明;

TOMST Lolly Privacy Policy

Application: TOMST Lolly, China edition (Android)

Version 2026-10-22. Effective date and last updated: 22 October 2026.

This policy is published in Chinese and in English. Both texts have the same meaning. If they ever differ, the Chinese text applies to users in mainland China. Your agreement covers both texts, whichever one you read.

1. Who handles your information and how to reach us

TOMST Lolly is developed and provided by TOMST s.r.o., a company registered in the Czech Republic (Michelská 964/78, 141 00 Praha 4, Czech Republic; VAT number CZ27139140), which also runs the server tomst.cn that the app connects to. In this policy "we" and "TOMST" mean TOMST s.r.o.

Privacy questions and requests: tomst@tomst.com. Technical support and diagnostic logs: app@tomst.com.

Our contact in mainland China is SHANGHAI SAFE BIOTECH CO LTD (上海赛弗生物科技有限公司), email 1364685620@qq.com. You can write to them in Chinese about anything in this policy; they pass your request to TOMST and TOMST answers. SafeBio distributes TOMST's hardware in mainland China and links to the app's download page; it does not host, sign, change or distribute the app, and it receives no information from it.

Who is responsible for what. Under the Personal Information Protection Law of the People's Republic of China, TOMST is the personal information handler for how the app handles personal information, including asking for your consent before it uses your location (section 11), and for the personal information TOMST receives: the requests the app makes to tomst.cn (section 7), the diagnostic logs and crash reports you send (sections 8 and 9) and the emails you write to us (section 10). Under the EU General Data Protection Regulation (GDPR), which applies because TOMST is established in the European Union, TOMST is the controller of what it receives. What the app stores on your device, such as measurements, site names, notes, photos and positions, stays under your control or that of the organisation you work for, which decides what is recorded and what happens to it; TOMST does not receive this information, has no access to it, and designs the app so that it stays on the device unless you send it out.

This edition of the app is made only for users in mainland China.

2. Summary

  • Lolly needs no account and works without internet. Your measurements, sites, notes and photos stay on your device unless you yourself send, share, export or upload them.
  • The app contains no advertising, analytics or tracking, and no TOMST server collects your measurements by itself.
  • The app connects to tomst.cn by itself in two cases only: at the first setup, before you agree, to fetch this policy and the User Agreement so that you can read them; and after you agree, at each start, to check for a newer version and for a notice from TOMST. These requests carry no identifier of you or your device; the server uses your connection's IP address only to answer and does not keep it (section 7).
  • Everything else leaves the device only when you decide: a diagnostic log or a crash report you send to TOMST, each time behind a box you tick (a log contains the measurements and serial numbers of the dataloggers it covers, a crash report contains no measurements), an email you send from your own email app, an upload to your own server that you set up, or a file you share or export.
  • Location is optional and stays on your device.

3. What this policy covers

This policy explains what the China edition of TOMST Lolly for Android does with information: what stays on your device, what leaves it, where it goes, how long it is kept and what your rights are. Section 6 lists everything that can leave the device.

Lolly is companion software for TOMST dataloggers: it downloads their measurements through TOMST's USB adapter, shows them and saves them. It has no user accounts, subscriptions, payments, advertising, social features or features for publishing content to other users, and no cloud storage of its own. It is installed from the download page on tomst.cn, not from an app store. TOMST has no server, office or company in mainland China. The app is intended for professional, scientific and technical work by adults, not for children under 14 (section 21).

4. No account, no registration

Lolly has no user accounts. You do not register or sign in, and you do not give us your name, phone number or email address to use the app.

The app records on your device which versions of this policy and of the User Agreement you accepted, so that it can ask you again when a text changes; it does not send that record to TOMST. If the download page on tomst.cn asks you to confirm your acceptance before a download, TOMST keeps no record of that confirmation either. The only account details you ever enter are those of your own server, if you set up Auto export (section 13).

5. What stays on your device

Lolly stores its work in a data folder you choose during setup (by default Documents/Lolly) and in the app's private storage, which other apps cannot normally read:

  • the measurement files downloaded from your dataloggers, and files derived from them (for example soil moisture conversions and repaired copies);
  • what you add to a download: a site name, a note, photos;
  • what Lolly records with a download: the date and time, the datalogger's serial number, type and firmware, how full its memory was, how far its clock was off, how the download ended, and the position, if you allow location;
  • logs of the communication with the datalogger (below), and crash reports until you send or delete them (at most 30 days, the 40 most recent);
  • the app's database, the backups you create, your soil calibrations and your settings, including which versions of these texts you accepted;
  • if you use Auto export, your server's address, your user name and password or SSH key, and the list of files waiting to be uploaded;
  • temporary files, for example an archive being prepared for sharing.

None of this is sent to TOMST by itself. Lolly's private storage is left out of Android's automatic backup and of the transfer to a new device, so on a new device Lolly starts empty; your data folder and your own backups are how you move your work.

Logs. Lolly saves a raw log with each download in your data folder, and keeps diagnostic logs of recent sessions with the adapter in its private storage, where older ones are removed automatically. Both are complete records of the communication between Lolly and the datalogger: they contain the measurements themselves, the serial numbers and firmware of the datalogger and the adapter, the app version and the device's make, model and Android version. They do not contain your position, site names, notes or photos. Treat a raw log like the measurement file it belongs to.

6. What leaves your device

This is the complete overview; the sections named give the details. The China edition uses no Google service and contains no third-party advertising, analytics or tracking component (section 16).

Connections the app makes by itself, to tomst.cn only:

  • fetching this policy and the User Agreement in your language, at the first setup before you agree and whenever you open them (section 7);
  • the update check and the look for a notice from TOMST at each start after you agreed, and the download of a new version once you confirm it (section 7).

Only when you decide:

  • an update check when you tap Check for updates (section 7);
  • diagnostic logs you send to TOMST (section 8);
  • crash reports you send to TOMST (section 9);
  • emails you write to TOMST with your own email app (section 10);
  • uploads to your own server, once you set up Auto export (section 13);
  • files you share, export or back up yourself (section 14).

The app does not send your measurements, position, photos, notes or site names to TOMST automatically. TOMST receives them only inside a log, an email or an attachment that you chose to send.

7. Automatic requests: the legal texts and the update check

What the requests carry. The update check, the download of an update and the look for a notice carry the app version and version code, the edition, the Android version and a fixed code that identifies the app, not you; the requests for the two texts carry only the app version, the edition and the Android version. Like every internet connection, they also reveal your connection's IP address to the server. They carry no identifier of you, of your device or of this installation, and the app sends no separate "installed" message.

How the server handles them. tomst.cn is run by TOMST on rented hardware in Hong Kong. It uses the IP address only to answer the request and writes it into no log of these requests. Only a connection that fails before any request is made, or a stray packet that the server's firewall blocks, can leave an address in the server's general error or firewall log, for up to four weeks and without anything about the app. The hosting companies that provide the hardware in Hong Kong and Germany may keep network data of their own. For updates, the server keeps only daily counts of requests: update checks per app version, edition and Android version; downloads per app version, the completed ones also per edition; and requests turned away because too many arrived at once. These are counts of requests, not of devices: a device that starts the app several times a day is counted several times, and the counts cannot tell one device from another. The requests for the legal texts are not counted.

Installing an update. When a newer version is offered, the app tells you what it brings and asks you to confirm, in a box that is never ticked in advance, that you have read the User Agreement and this policy; on mobile data it also tells you the size of the download and asks before downloading. The first time, Android asks you to allow Lolly to install apps (section 15). Before installing, the app checks that the file is complete and signed by TOMST, and then Android asks its own question. Nothing is downloaded or installed without your confirmation.

Notices from TOMST. At each start after you agreed, the app also asks tomst.cn whether TOMST has a notice about the app or the equipment, for example about a fault, a security problem or the end of the beta, and shows it in your language. This request carries the same information as the update check and is not counted. A notice holds only text and possibly a link to tomst.cn; it cannot change anything in the app or on your device. You can tick "Don't show again" to stop a notice; otherwise it is shown again at the next start.

Why the requests are needed. A beta version stops working on its end date (User Agreement, section 4), and faults and security problems are fixed only through new versions, so without the check the app could stop, or stay faulty, without telling you. The counts show TOMST which versions are still in use, so that it knows when an old one can be retired. The texts are fetched before you agree because you cannot agree to texts you have not been able to read.

Legal basis. Under the Personal Information Protection Law, the update check, the look for a notice and the update download are necessary to perform the User Agreement with you (Article 13(1)(2)), and fetching the two texts before you agree is necessary to conclude it (same article). Under the GDPR, the update check, the look for a notice and the update download rest on TOMST's legitimate interest in keeping the app it provides secure and up to date, in telling you about faults and in knowing which versions are in use (Article 6(1)(f)), and fetching the two texts is a step you take towards the agreement by starting the app (Article 6(1)(b)). Agreeing to this policy is not the legal basis for these requests. Because they carry no identifier, their IP address is not kept and nothing links one request to another, their effect on you is limited.

Your right to object. Under the GDPR you can object to the update check and the look for a notice at any time (section 19) by writing to tomst@tomst.com; TOMST will consider your objection and answer it. The app has no switch for the check, so the immediate way to stop the requests is to use the app without an internet connection; all its core functions work that way.

8. Diagnostic logs you send to TOMST

Several buttons prepare a diagnostic archive: "Send logs to TOMST" and "Email logs to TOMST" (in Settings, in the graph's data tools and in the message shown when a datalogger looks faulty), "Send feedback" in Settings, and "Send to TOMST" on the card of a file Lolly cannot read. Lolly never sends the archive by itself. A dialog shows one box, never ticked in advance: "I have read the privacy policy and agree to send this diagnostic log to TOMST for technical support, including processing outside mainland China. I know it holds the measurements and serial numbers of the dataloggers it covers." The privacy policy opens from the same dialog, and the box is asked again for every send. Only after you tick it can you choose:

  • "Send to TOMST": the archive is uploaded over an encrypted connection to tomst.cn and stored on TOMST's server in Germany. You get a reference number to quote when you contact us. The server stores the archive with the date, the app version, the kind of send and the reference, and no IP address.
  • "Prepare an email": your own email app opens with the archive attached and app@tomst.com as the recipient. It is sent only if you press send, and we then also receive your email address.

A switch, "Just a bug report, no reply needed", is on for every new send. If you want TOMST to answer, switch it off and enter your email address: it travels with the archive, is kept with it and is used only to reply to you about that send.

What an archive can contain:

  • a short report: the note you typed, the app version and edition, the Android version and build, the device's make, model and memory, the time of creation, a list of the app's recently handled errors (their kind and place in the code, without file paths or message texts), and the names and sizes of the files in the archive;
  • the diagnostic logs (section 5) of the datalogger concerned and, within the size limit, of other dataloggers recently used on this device, with the measurements of those downloads and the serial numbers and firmware of the dataloggers and the adapter;
  • when something failed, the record Lolly set aside at that moment, and when a datalogger looks faulty, a short technical report about it;
  • records of firmware updates, if you tick them in Settings.

Not in the archive: your position, site names, the notes you attached to downloads, photos, your settings, the measurement files as files, and the raw logs kept with your downloads.

Serial numbers. A datalogger's serial number identifies a device, and TOMST may be able to link it to a customer through its sales or service records. We use such a link only to answer you and to help with your equipment and data, and we build no profile of people from it.

Purpose: to answer your support request, to find the cause of a fault in the app, the adapter or the datalogger, and to help with your data when you ask. Legal basis: your consent, given by ticking the box for that send (Personal Information Protection Law, Articles 13(1)(1), 14 and 39; GDPR, Article 6(1)(a)), which also covers an email address you add for a reply. Sending is voluntary, and nothing else in the app depends on it. Retention: section 18.

9. Crash reports you send to TOMST

When the app closes unexpectedly or stops responding, it writes a report on your device and sends nothing. At the next start it asks you once whether to send it, behind a box that is never ticked in advance: "I have read the privacy policy and agree to send this crash report to TOMST for technical support, including processing outside mainland China. It holds no measurements." The same reply switch as for logs is on; switched off, you can enter your email address, which travels and is kept with the report. A report you do not send stays on the device for up to 30 days. In Settings, under "Crashes and logs", you can see every report kept on the device with its date and app version, send any of them (again behind the box) or delete them.

A report contains: the app version, edition and build; the device's make and model, the Android version, the processor type, the app's language and the size of its memory as a rough class; how long the app had been running and how much memory it used; the error with its stack trace and how Android ended the app; the state of the app at that moment, such as the screen that was open, the state of a download, whether the phone's clock had been checked against satellite time, and what kind of storage your data folder is on (never its name or path); the app's recent event log, with times to the minute and without anything you typed; counts of repeated crashes and of handled errors; and the type and firmware of the connected datalogger.

The app puts no identifier of you or your device into a report, and no position, region or time zone, measurements, photos, notes, site names or folder, file or server names. Serial numbers of dataloggers and adapters are not sent as fields of a report, and the app removes from the report's texts the serial numbers it met while it was running, file names, addresses and email addresses (other than yours, if you entered it for a reply). These filters run automatically; they greatly reduce, but cannot completely rule out, that an error message still contains something identifying.

A report you send travels over an encrypted connection to tomst.cn and is stored on TOMST's server in Germany with the date and the app version, without any IP address. Purpose: to find and fix faults in the app. Legal basis: your consent, given by ticking the box for that report (Personal Information Protection Law, Articles 13(1)(1), 14 and 39; GDPR, Article 6(1)(a)); sending is voluntary. Retention: section 18.

10. Emails you send to TOMST

Lolly never emails anyone by itself. Its email options open your own email app with a message addressed to app@tomst.com, which you can read, change, strip of its attachment or close; it is sent only if you press send. Such an email contains what you wrote, technical details of the app and the device (app version, Android version, make, model and memory) and, if you chose so, the archive described in section 8. We also receive your email address.

We use these emails to answer you, to find the cause of a problem, to help with your data and to improve the app and the dataloggers. They go to TOMST in the Czech Republic through your own email provider. Legal basis: your consent, given by sending the email (Personal Information Protection Law, Articles 13(1)(1) and 39); under the GDPR, TOMST's legitimate interest in answering you and solving the problem you raise (Article 6(1)(f)). Retention: section 18.

11. Location

Precise location can be sensitive personal information under Chinese law, and Lolly treats it as such. In Lolly it is optional: the setup step says what it is for before Android asks for the permission. You can skip it, refuse it, or withdraw it later in Android's settings or by switching GPS off in Lolly's Settings.

If you allow it, Lolly uses your position to:

  • record where a download was made (latitude, longitude, altitude above sea level and the accuracy of the fix), saved with that download on your device;
  • suggest a name for the place, looked up on the device from map data built into the app, without sending your coordinates to any online service;
  • show your position, region and altitude on the Home screen;
  • check the phone's clock against satellite time before Lolly sets a datalogger's clock;
  • add coordinates to a photo you attach, when the photo has none of its own.

Lolly uses your position while the app is open and does not ask for background location. A download can continue with the screen off; meanwhile Lolly may check the phone's clock against satellite time, and when the download finishes it saves the last position the phone already had.

GPS coordinates are in the WGS-84 system. So that you can use them in Amap, Tencent Maps or Baidu Maps, the app also shows them converted to GCJ-02 and BD-09; the conversion happens on the device and the data files keep the original coordinates. If you tap a saved position, Lolly opens it in the map app you choose and hands that app the coordinates.

If you refuse, only what depends on the position changes: downloads are saved without coordinates and without a suggested place name, the Home screen shows no position, region or altitude, photos you attach get no coordinates from Lolly, and Lolly cannot check the phone's clock against satellite time before it sets a datalogger's clock, so it relies on the phone's clock as it is. Downloading, viewing, saving and exporting measurements work as before.

What this means for you: saved coordinates show where you work, and anyone you give a file with them to learns those places. The coordinates stay with the download on your device and leave it only inside files you export, share, back up or upload with Auto export (the download's info file, map files and photos). They are never part of a crash report or a diagnostic log, and TOMST receives your position only if you send it to us yourself, for example in a file attached to an email.

Legal basis: your separate consent, given on the setup step that states the purpose and then in Android's own permission question (Personal Information Protection Law, Articles 13(1)(1), 29 and 30), which you can withdraw at any time as described above.

12. Photos

You can attach photos to a download, taken with your camera app, picked from the device or shared into Lolly from another app; Lolly itself has no camera permission. Lolly writes into an attached photo's metadata (EXIF) the serial number of the datalogger and, when the photo has no coordinates of its own and Lolly knows the position, the coordinates of the place. Other metadata already in the photo stays in it.

Photos stay on your device and leave it only inside an export, a share, a backup or an Auto export upload that you set to include photos. Because their metadata travels with them, a photo you pass on can reveal the datalogger, the place and whatever the photo already recorded.

13. Auto export to your own server

Auto export is off until you set it up in Settings. Once it is on, every finished download is uploaded by itself to the destination you chose: your own WebDAV server (for example Nutstore or Nextcloud) or SFTP server. Uploads run in the background and follow your "Only on Wi-Fi" setting.

Lolly talks to your server directly; TOMST is not in between and gets no copy. You enter the server's address, a user name and a password; for SFTP you can use an SSH key instead, which Lolly can create on the device or import. The private key stays on the device and is never sent to TOMST, to the server or into any backup; if you gave your server Lolly's public key, remove it there when you no longer want Lolly to connect. Lolly refuses to connect to an SFTP server whose identity has changed until you confirm it.

What is uploaded: in "Auto export" mode, each download as readable files (the measurement file; an info file with the site name, your note, the coordinates and what Lolly recorded about the download; the map files you select; the soil-converted file and the site photos if you switch them on; and the download's raw log). In "Auto backup" mode, each download as one backup file holding the same information, plus your app settings. Passwords and keys are never part of a backup.

Security: uploads travel over an encrypted connection (HTTPS or SSH). Server passwords and private keys are stored on the device encrypted with a key held by the Android keystore.

Responsibility: you choose the destination and what is uploaded, and the destination's operator handles the files under its own terms; the destination may be outside mainland China. TOMST provides this function of the app and is responsible for it working as described here, but does not receive the uploaded data or decide what happens to it there.

Stopping it: pause or turn off Auto export and uploads stop. Deleting the server in Settings removes its saved details from your device. Lolly never deletes anything on your server.

14. Files you share, export or back up yourself

Lolly can share or save an archive of the downloads you select, save a chart as a picture and create a backup of its database. Each time, you decide where the file goes. Such files can contain measurements, datalogger serial numbers, site names, notes, coordinates and photos with their metadata (sections 5, 11 and 12). Once you hand a file to another app or person, it is handled under their rules, so please consider what you pass on, especially other people's information.

15. Permissions

The permissions the China edition holds, and why:

  • Location (precise and approximate): optional, section 11.
  • Notifications: needed. While Lolly talks to a datalogger, Android shows a notification, which is what lets a download continue with the screen off; Lolly also uses notifications for the progress and results of downloads, exports and uploads, never for marketing.
  • USB device: Android asks you when you plug in the adapter.
  • Internet and network state: the automatic requests (section 7), the sends you choose and Auto export.
  • Install apps: only to install an update downloaded from tomst.cn, and only after your confirmation (section 7). The first time, Android opens its own "Install unknown apps" setting so that you can allow Lolly; you can switch it off there at any time, and Lolly will ask again at the next update.
  • Storage (Android 9 only): to save a photo from Lolly's photo viewer to the gallery.
  • Permissions that give the app no access to your personal information: running in the foreground and keeping the device awake while a download or firmware update runs, continuing a waiting upload after a restart, vibration, and fast sensor readings for rain mode.

Your data folder needs no storage permission: you choose it in Android's own folder picker, and Lolly can use only that folder. Lolly also reads the motion, pressure, light and proximity sensors, which need no permission; their readings are used on the spot and are neither saved nor sent. Lolly does not ask for the camera, the microphone, contacts, calendar, phone, messages, Bluetooth or background location, and reads none of the device's own identifiers.

16. Third parties and service providers

The app shares personal information with no third party by itself. These parties can receive something, and only on your action: the operator of your own server, when Auto export uploads to it (section 13); the map app you choose, when you tap a saved position (section 11); your email app and email provider, when you send an email (section 10); the camera app and any app you share a file with (sections 12 and 14); and your browser, when you open a link from the app.

Service providers: TOMST rents the hardware of its servers in Hong Kong and in Germany from hosting companies, which provide the machines and the network on which tomst.cn and TOMST's storage server run.

Third-party code: the app contains no advertising, analytics or tracking component. It contains open-source components and, in its code, a crash-reporting library made by Google (Firebase Crashlytics) with the Firebase libraries it depends on. In this edition the app does not start them, and they are not used to collect or send anything.

17. Information sent outside mainland China

TOMST s.r.o. is in the Czech Republic. The tomst.cn server is in Hong Kong, and the logs and crash reports you send are stored on TOMST's own server in Germany:

  • The automatic requests (section 7) reach only the Hong Kong server, where the request and your connection's IP address are handled for the length of the connection and not kept, apart from the exception section 7 describes.
  • A diagnostic log or crash report you send passes through the Hong Kong server to TOMST's server in Germany; the Hong Kong server passes nothing about your connection on.
  • An email you send goes to TOMST in the Czech Republic through your own email provider.

What the Personal Information Protection Law asks us to tell you about this: the overseas recipient is TOMST s.r.o. (contact in section 1); the purpose of the automatic requests is to provide updates and the current texts, and the purpose of what you send is technical support and finding and fixing faults; the information is what sections 7 to 10 describe and nothing more; it is transferred over encrypted connections, stored on TOMST's servers, accessed only by the TOMST staff who handle support and development, and deleted as section 18 says; and you exercise your rights towards TOMST by writing to tomst@tomst.com or through our contact in mainland China, as section 19 describes.

Consent: the automatic requests rest on the performance of the User Agreement (section 7), so no separate consent is asked for them; you avoid them only by using the app without an internet connection. For each diagnostic log or crash report, ticking its box is your separate consent to that one transfer, and nothing is transferred without it. Pressing send in your email app is your consent to that email.

Under the GDPR, what you send is stored inside the European Union, on TOMST's server in Germany or, for emails, at TOMST in the Czech Republic; the Hong Kong server only passes it on. Uploads with Auto export go where you point them (section 13).

18. How long information is kept and how it is deleted

On your device: what you create or download stays until you delete it. Lolly removes crash reports by itself after 30 days and older diagnostic logs automatically. Uninstalling the app, or "Clear storage" in Android's settings, removes Lolly's private storage (its database, settings, server password, SSH key, diagnostic logs and crash reports). Your data folder stays on the device, and anything you uploaded, shared or emailed stays where you sent it until you delete it there.

At TOMST:

  • an uploaded diagnostic log is deleted 180 days after it arrived; it is kept longer only while a support case about it, or about the same equipment, is still open, and is deleted when the case ends;
  • a crash report is deleted 180 days after it arrived;
  • an email is kept as long as needed to handle your request and to understand later problems with the same equipment;
  • the update counts identify nobody; an address that reached the general error or firewall log (section 7) is gone within four weeks.

You can ask for anything you sent to be deleted earlier at any time (section 19). Where the law requires TOMST to keep something longer, it is kept only as long as required.

19. Your rights and how to exercise them

Under the Personal Information Protection Law of the People's Republic of China you have the right:

  • to know and to decide how your personal information is handled, and to restrict or refuse it: this policy is the explanation, and you can decline it and not use the app;
  • to access and copy: what the app holds is on your device, where you can view and export it at any time; for anything you sent us, you can ask us for a copy or, where the conditions set by law are met, for its transfer to another handler you name;
  • to correct and complete: change site names, notes and photos in the app, and tell us if something you sent us is wrong;
  • to delete: delete anything on the device yourself, and ask us to delete a log, a crash report or an email you sent;
  • to withdraw consent: for location, take the permission back in Android's settings or switch GPS off in Lolly's Settings; for a log or crash report you already sent, the upload itself cannot be undone, but you can withdraw your consent to keeping it at any time by writing to tomst@tomst.com or app@tomst.com, and we then delete it. Withdrawing does not affect what was done before, and every new send asks you again;
  • to ask us to explain this policy or how we handle your information;
  • for the close relatives of a deceased user, to exercise these rights on the deceased person's own information, unless the person arranged otherwise.

Under the GDPR you have, for what TOMST holds about you, the right of access (Article 15), to rectification (Article 16), to erasure (Article 17), to restriction of processing (Article 18), to receive what you sent with your consent in a portable form (Article 20), to object at any time to processing based on TOMST's legitimate interest, such as the update check (Article 21), and to withdraw a consent at any time without affecting what was done before (Article 7(3)). TOMST makes no decision about you by automated means alone and does no profiling (Article 22).

How to make a request: write to tomst@tomst.com or to our contact in mainland China (section 1). Because the app has no accounts, please tell us the reference number of an uploaded log, or the date and app version of a crash report (Settings, "Crashes and logs" shows them), so that we can find it. We ask only for what we need to find the information and to be reasonably sure that the request concerns your own data, and we charge nothing for a reasonable request. We act on a request without undue delay and reply within 15 working days. A request under the GDPR is completed at the latest within one month of receipt; where it is complex or one of many, the GDPR allows up to two further months, and we then tell you within the first month why it takes longer. If we cannot do what you ask, we tell you why and how you can complain (section 23).

20. Security

Sends to TOMST and uploads to your own server travel over encrypted connections, and server passwords and SSH keys are protected on the device as section 13 describes. On TOMST's servers, access to logs and crash reports is limited to the TOMST staff who handle support and development, and they are deleted on schedule.

Your measurement files are ordinary files in your data folder: anyone who can open that folder can read them, and so can apps you have allowed to read your files. Their safety depends on your device's lock, on where the folder is and on the services you sync it with. No system is completely secure. If a security incident affects information you sent us, we inform the authorities as the law requires, and we inform you by the contact you gave us where we have one, or otherwise by a notice on tomst.cn.

21. Children under 14

The app is made for professional, scientific and technical work by adults and is not for children under 14; the app does not check anyone's age. We do not knowingly collect personal information from children. If you are a parent or guardian and believe that a child has sent us something through the app, write to tomst@tomst.com and we will delete it.

22. Changes to this policy and earlier versions

When this policy changes in substance, TOMST publishes the new text on tomst.cn together with an app update, and at the first start after that update the app shows the new text and asks for your agreement again. Until you agree, the app neither checks for updates nor sends anything to TOMST, apart from fetching these two texts; an Auto export you set up earlier keeps uploading to your own server. You can read both texts at any time on the app's About page; the app fetches them from tomst.cn each time, so this needs an internet connection, and it keeps no copy on the device. The version date stands at the top.

The current version is published at https://tomst.cn/TOMSTLolly-china/Android/legal/privacy/. TOMST keeps the earlier versions with their dates and, on a reasonable request, provides you with the version that applied to you, at tomst@tomst.com.

23. Complaints and contact

If you are unhappy with how we handle your information, please write first to tomst@tomst.com or to our contact in mainland China (section 1), so that we can put it right. You also have the right to complain to the Cyberspace Administration of China (reporting hotline 12377, www.12377.cn) and, for matters about the app's permissions and behaviour, to the reporting centre of the Ministry of Industry and Information Technology (12321, www.12321.cn). Under the GDPR you can also complain to a data protection supervisory authority, in particular to the one responsible for TOMST, the Czech Office for Personal Data Protection (Úřad pro ochranu osobních údajů, Pplk. Sochora 27, 170 00 Praha 7, Czech Republic, www.uoou.gov.cz).
